What appears to be a private email for our HOA/SC addresses some very important questions that could again affect us all. We hereby ask the SC to forward us the email so we can post and all can read its contents. We also ask the SC to answer the questions below. We are all homeowners here and deserve answers.
The email is sent from an Attorney named Cristo Markou.
Please join us in demanding answers to these very important questions. (outlined below) You can see based on who was copied on it, it seems to be written for the benefit of the same group ( less their fearless leader who they kicked aside.)
Our questions are:
1) Who is Cristo Markou?
a) Is he hired and or contracted by the " self appointed" SC and its advisors?
b) if so, under what terms and money obligations?
c) Will he represent the group of owners being sued both criminally and civilly by the developer and or Ralf Henrich?
d) If so, will these owners pay all of their own legal fees and sign an agreement with the community to confirm this?
2) If you engage the HOA into another lawsuit with Julio Brown, will you personally pay ALL legal fees to defend this suit for terminating the legal contract with Julio Brown?
3) We have listed the September 23rd, resignation letter of Jeannie Bell from the SC, Is it fair to say anyone can at their leisure and desire resign and rejoin the SC anytime they want without consent of knowledge of the community? Is this in your self defined guidelines too?
4) So we now have what appears 2 different attorney's the HOA is paying for giving us 2 different legal answers on the validity of a General Assembly meeting. So we are so so confused, who do we believe and to confirm you all agree to pay these lawyers personally for the mess you have created as a group?
5) Of those in your group, which of you are
a) being sued by the developer and Henrich?
b) Lost your memberships to the club due to your actions?
c) Do not even wish to live in VE anymore or have not been here in over 1 year ( regardless of reasons).
d) Wish to negotiate a private deal with the developer to cancel your self inflicted problems per above?
We think it very clear for all to see the private agenda!
Good Luck getting many of us to financially support your self inflicted messes per above unless you satisfy with us per above in writing, we reserve the right to fund any fees outside of standard HOA obligations of security, improvements, trash pick ups and essentials to the VE community.

Does this Cristo Markou have power of attorney for the VEHOA? I know Julio Brown did and it was signed by the president of the VEHOA as required by law.
I would hope the answer to the POA
is "No".
The SC just keeps hiring lawyers till they find one that will agree with their lies. At what cost to us, the homeowners???

If Cristo has no POA then he cannot represent the VEHOA or the SC. I hope that this group of 3 woman, who are in no way legal, did not commit any HOA funds for this "new" lawyer. If it is proven that they did, in spite of legal opinions that they are not legitimate and after that they were clearly told by the VEHOA president not to, then they need to have criminal charges filed against them. Can someone please post the contact info for Julio Brown. If he is the contracted HOA attorney then he should file these criminal charges on behalf of the membership.

Jim Maffet has issued a $700 check to Cristo Markou
The checkbook must be taken from Maffett. Who gave him permission to make a check to Cristo. and for what? November 30 is not coming soon enough and the SC is going to rob us blind. Are we now paying for the defense of Jeannie Bell? This has got to stop -- take the checkbook from Maffit -- go to the bank and freeze the account until we have an honest, legally elected SC abd BOD.
I am concerned for Mr. Maffet. Not sure who instructs him to issue checks but if Markou is not a sanctioned attorney for VEHOA is he not exposing him self to legal problems or can you declare you were only taking orders. But then it is apparent who ever is giving orders is not legal? So many questions so few answers.

In answer to the question below, Yes it is possible that the SC is using our money to try and get their memberships back, since the they won't answer the questions asked of them on this blog. They are obviously hiding the truth from us. Otherwise they would answer the questions that over 65+ separate homeowners want answered.
Is it possible that the lost golf memberships are being fought by Cristo using VEHOA monies? He was originally hired to fight for some of the membership revocations, and since our attorney has said that no checks can be written to establish ANY new contracts, is it possible his time is being used for other than VEHOA purposes?
Looks like the $700 payment to Cristo Markou from the "illegal" SC, via a check signed by Jim Maffet, can be considered theft since there is no mechanism for the SC to give Markou any POA to represent the VE homeowners.
Looks like criminal charges for theft against Bell, Bruner, and Mains will be forthcoming shortly, especially since they were put on notice to not do this.
This would be the third criminal charge against Bell for her actions on the SC. Not to bright.
Bell has a lot more than theft and slander suits coming her way..... this Bell character has taken on a psychotic obsession with the SC and will do anything and cross anyone to get her golf membership back.... mind you her house may be getting a sale contract, then what, will she resign? If she is under contract she has to, and then definitely she may be facing up jail time for knowingly defrauding the VEHOA.
Maffitt is a decent man and the only one with bank signature at this time.
This SC is out of control and must be stopped, but thus far, the elections do not seem real or possible. Where are the ballots, the candidates, the voting instructions.

you are right,I guess that is why she is using VEHOA funds to fight the membership and has crossed all legal boundaries to use Cristo (her lawyer) as VEHOA lawyer, she needs that membership back to sell and be out of VE, but will she be out of the SC, and how much $$$$$ is it going to cost VEHOA all this psychotic break of hers..

You have good points here. I am going to check with my attorney and see about the cost to sue the sc individually, starting with miss Bell, and I will pass the news onto any others interested.

Home values in Valle Escondido are now at way low, thanks to Ms. Bell and cohorts. Her house is probably on fire sale because nobody i their right mind will touch VE properties because of the lawsuits affecting everyone and everything. Yes, Bell should be sued for causing devaluation to our homes by her libelous comments directed toward the Developer, who in turn has sued VEHOA. Yes, Bell is responsible for what is happening and she will bear the punishment. Bell refuses to see that she was and is being used by the others with their own personal agendas, especially Carol Brunner. Ms. Brunner, who hasn't even stepped foot in Panama in over a year, is just as reckless but she is not in Panama to accept the criminal charges against her. Once she sees Ms. bell sentenced to prison, and severely fined, for her numerous deliberate criminal actions, of which all the rest of Charbit's original clan are just as responsible for, Ms Brunner, and the rest of the clan who have been criminally charged but stayed out of Panama to avoid being served, will never return to VE.

In her desperation, Jeannie Bell is coming up with all kind of bullshit. Yes, Jeannie Bell, the homeowners want the transfer of assets; but FIRST AND FOREMOST, we, the homeowners, WANT YOU OUT! Is that too hard to understand! When your self-appointed members of the SC are finally gone, the asset transfer will take place, and it will be done with no mess up. Don't you realize that you are standing in the way of peace and tranquility in this community? Like Katrina, your arrival here has done nothing but brought havoc. You can try all the tricks in the world but that's not going to bring you the glory you are seeking. You are the proverbial tadpole wanting to be a big fish in a small pond. Everyone sees you as nothing more but a social climber trying too hard to be accepted. There are better and more capable people who can do the job -- step down and let someone take over. Believe me, anyone will do better than you. Accept your shortcomings and be a good sport. Be humble --Step down.
Ms. Bell, you have painted yourself into a corner. Trying harder will only make it worse for you and the community you supposedly serve.
A sign of wisdom is knowing when to let go. Although this is hard on the ego, it is clearly your best option.
