Steering Committee Update March 5, 2015

Good Day All.

We have a few items to update the community about.   Mostly good news and even some really good news about the bank, asset transfer, water and security.

Bank and Dues:

Big Big News for all members of the VEHOA.  The bank has finally completed their rather extensive review of all of the documents presented to them regarding the election of January 12, 2015 and has now released all holds on the bank accounts to the new Board of Directors and the new Steering Committee. Simply put, the bank says the BOD and SC are the legal representatives of the VEHOA.

We can now safely start receiving 2015 dues. The invoices will be emailed as soon as we finalize a couple payment options.  The proposed budget is finalized and should be emailed out later today.  The really good news is that there will be no dues increase for 2015!  The dues will be $1554.00, same as last year.   All payments  will go directly into the VEHOA bank account.  Checks will be made out to Asoc. De Propietarios Valle Escondido, cash directly deposited into the account, credit card payments will have a VEHOA payee.  There will be no checks made out to an individual, no cash directly accepted.   

Details on making the deposits will be included with the invoices but if anyone needs to make a payment immediately because of travel or other conflicts please send and email to either myself or the SC treasurer Joel Mahler joelmahlerve@gmail.com and we will give you details on how to make the deposit.

Water:

The Vista Baru area water supply and delivery is much improved though still not completely fixed.  Through the efforts of Ralf Henrich and others as well as a significant effort from Liberty Services a massive leak, probably existing for years, was found and repaired.  We believe there are other less extensive leaks that still have to be tracked down but we are out of crisis mode.  The Noria tanks are still being shut off during the night to allow the tanks to fill which is why water pressure in the area drops late in the evening.  We are still investigating these leak issue and will report any findings.

Security:

As we have reported previously we have dismissed Blasco as of March 8th.  Despite repeated requests they never produced the individual gun permits as required by law.  Until such time that we can make a permanent replacement we will be sharing the gate guards with the resort.   The resort will also be providing us with a second roving guard.   We are in negotiations with the resort to continue to share the gate guard and to a lesser extent share the roving guard.  This arrangement, if and when we come to an agreement, stands to provide significant savings with no reduction in security.   We also have money in the budget to improve the technology at the gate and fence which will also enhance our security.

Asset Transfer:

We have formed a three person subcommittee to start talking with the developer’s attorney about the transfer of assets.  The committee is made up of Stan Hime, Caesar Sherrard and Mark Schneider.  Additional persons maybe added if the need arises. 

The first issue that has come up is the previous SC, via one of their advisors, has contacted the developer’s attorney in an attempt to stop any talks.   That attorney then did his own due diligence and discovered exactly what the bank discovered.  The January 12th, 2015 election was legal and the new BOD and SC have the right to represent VEHOA.  Additionally he discovered that despite numerous statements about a lawsuit having been filed to overturn the election, in fact, regardless of many statements to the contrary, as of today no such lawsuit has been filed.

Since the asset transfer has been labeled such a critical event for the HOA it would seem counterproductive for anyone to attempt to get in the way of these talks.   We will continue to keep everyone abreast of developments in this area.   And of course, any agreement that is reached by the committee will have to be approved by a vote of the homeowners.
